Terms of Service
These Terms of Service (“Terms”) govern access to and use of the Move With Gorilla website, platform, services, dashboard, communications, and related systems operated by Six Eight Logistics Inc., a California corporation doing business as Gorilla Movers and Move With Gorilla(“Company,” “Gorilla,” “we,” “our,” or “us”).
By accessing, browsing, creating an account, or using the Move With Gorilla platform, you agree to these Terms.
If you do not agree to these Terms, you may not use the platform.
1. Platform Overview
Move With Gorilla is a referral submission platform operated by Gorilla Movers.
The platform allows approved users to:
- create accounts
- submit referral leads
- view limited dashboard information
- review payout information
- participate in referral-based incentive programs
Move With Gorilla does not guarantee:
- account approval
- referral acceptance
- commissions
- earnings
- uninterrupted platform access
- service availability
2. Eligibility
To use the platform, you must:
- be at least 18 years old
- be a resident of the United States
- provide accurate account information
- use your real legal name
- provide a valid phone number and email address
- comply with all applicable laws
Gorilla Movers reserves the right to reject, suspend, restrict, or terminate any account at its sole discretion.
3. Account Registration
Users are responsible for maintaining accurate account information.
You agree:
- not to share account access
- not to create multiple unauthorized accounts
- not to impersonate another person
- not to provide false information
- not to use disposable or fraudulent contact information
You are responsible for maintaining the security of your account credentials.
Gorilla Movers is not responsible for unauthorized access resulting from your failure to secure your account.
4. Acceptable Use
You agree to use the platform lawfully and responsibly.
You may not:
- violate laws or regulations
- interfere with platform operations
- attempt unauthorized access
- scrape or export data
- reverse engineer the platform
- use bots or automation tools
- submit spam or fake leads
- harass users or staff
- distribute malware or harmful code
- damage the Company's reputation
- misuse customer information
- attempt to bypass security measures
Gorilla Movers may investigate suspected misuse and take appropriate action.
5. Referral Program
Participation in the referral program is governed separately under the Move With Gorilla Referral Program Agreement.
In the event of conflict between these Terms and the Referral Program Agreement, the Referral Program Agreement controls regarding referral program matters.
6. Platform Access
Gorilla Movers reserves the right to:
- modify the platform
- add or remove features
- restrict access
- suspend operations
- update functionality
- discontinue services
without notice.
Platform availability is not guaranteed.
Temporary outages, maintenance interruptions, or technical failures may occur.
7. Communications and SMS Program
By creating a Gorilla HQ account, you consent to receive communications from Gorilla Movers (Six Eight Logistics Inc. dba Gorilla Movers), including:
- emails
- SMS / text messages
- account notifications
- payout notifications
- operational updates
- security alerts
- program updates
7.1 SMS Notification Program: Gorilla HQ
Program name: Gorilla HQ
Sender: Six Eight Logistics Inc. dba Gorilla Movers
Description: Gorilla HQ sends transactional SMS notifications to enrolled partners regarding the status of referrals they personally submit through our portal at movewithgorilla.com. These include booking confirmations, status updates, move-day notifications, and commission payout notices.
How to opt in: Partners opt in to the SMS notification program by checking the SMS consent checkbox when creating an account at movewithgorilla.com/signup. SMS notifications are not sent to anyone who has not explicitly opted in.
Message frequency: Message frequency varies based on referral activity. A typical partner receives 1–10 messages per month depending on the number of referrals submitted and their progression through the booking and completion process.
Message and data rates: Message and data rates may apply. Carrier rates depend on your mobile plan; Gorilla Movers does not charge a fee for SMS notifications.
How to get help — Reply HELP: Reply HELP to any message to receive support contact information. You may also email support@gorillamovers.com or call (858) 477-2446.
How to opt out — Reply STOP: You may opt out of the SMS program at any time by replying STOP to any message. You will receive one final confirmation message and will not receive further SMS notifications. You may also opt out by disabling SMS notifications in your account preferences at movewithgorilla.com/account, or by contacting support@gorillamovers.com.
Carriers not liable: Mobile carriers are not liable for delayed or undelivered messages.
No third-party sharing: Your phone number and SMS consent information are not shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.
7.2 Email Communications
Partners receive operational, account, and program emails as part of normal account activity. Promotional or recruitment emails may be sent and can be unsubscribed via the link in any such email.
Operational and account-related communications (security alerts, payout notices, account status changes) may continue to be sent even after opting out of promotional communications, as these are required for the service to function.
8. Intellectual Property
All platform materials remain the exclusive property of Six Eight Logistics Inc. and Gorilla Movers, including:
- logos
- branding
- software
- graphics
- website design
- content
- systems
- workflows
- customer data
- dashboards
- intellectual property
No ownership rights are transferred to users.
Users may not copy, reproduce, distribute, modify, or commercially exploit platform materials without written authorization.
9. Third-Party Services
The platform may integrate with or reference third-party services, including:
- payment providers
- analytics providers
- communication services
- hosting providers
Gorilla Movers is not responsible for third-party services, policies, or outages.
Use of third-party services may be subject to separate terms.
10. Disclaimer of Warranties
The platform is provided “as is” and “as available.”
Gorilla Movers makes no warranties regarding:
- uptime
- availability
- accuracy
- reliability
- earnings
- results
- referral success
- uninterrupted operation
To the fullest extent permitted by law, Gorilla Movers disclaims all warranties, express or implied.
11. Limitation of Liability
To the fullest extent permitted by law, Gorilla Movers and Six Eight Logistics Inc. shall not be liable for:
- indirect damages
- lost profits
- lost commissions
- business interruption
- lost data
- platform outages
- unauthorized account access
- technical failures
- referral outcomes
Total liability shall not exceed the amount paid directly to the user by Gorilla Movers during the prior twelve (12) months.
12. Indemnification
You agree to defend, indemnify, and hold harmless Gorilla Movers, Six Eight Logistics Inc., affiliates, employees, officers, and contractors from claims arising from:
- your use of the platform
- your violation of these Terms
- your unlawful conduct
- your misuse of data
- your infringement of rights
- your referral activity
13. Account Termination
Gorilla Movers may suspend or terminate accounts at any time, with or without notice, for:
- policy violations
- fraud concerns
- inactivity
- operational reasons
- legal compliance
- abuse of the platform
- business discretion
Users may request account deletion.
Gorilla Movers may retain records where reasonably necessary for:
- legal compliance
- tax reporting
- fraud prevention
- dispute resolution
- operational purposes
14. Governing Law
These Terms shall be governed under the laws of the State of California.
Any disputes shall be resolved in San Diego County, California.
Gorilla Movers may require disputes to be resolved through binding arbitration.
15. Class Action Waiver
To the fullest extent permitted by law, users agree to resolve disputes individually and waive participation in class actions or representative proceedings.
16. Modifications to Terms
Gorilla Movers may modify these Terms at any time.
Updated versions may be posted on the platform.
Continued use of the platform after updates constitutes acceptance of revised Terms.
17. Electronic Acceptance
By accessing or using the platform, you acknowledge that:
- electronic acceptance is legally binding
- electronic records may be retained
- electronic agreements are equivalent to physical signatures
